Our Terms & Conditions for Africa Tours Adventure Ltd

Kindly spare some minutes and read our terms and conditions Africa Tours Adventure Limited. By  confirming a booking with us at Africa Tours Adventure Limited, we assume that you have fully read, understood, and accept the terms and conditions below;

1. SERVICES:
2. Africa Tours Adventure Ltd arranges transportation, books accommodations, provides meals, excursions, and other services in partnership with other independent suppliers.
3. The information provided in the itinerary booked is always best on the updated information before the tour commences. Africa Tours Adventure is not liable for any information modified from third parties during the travel or changes that happen when they travel has commenced.
4. We shall require your full names as they appear in your passport, nationality, date of birth, expiry date, and passport number to enable us to reserve gorilla permits and flights.
5. You will be required to inform Africa Tours Adventure of any preferences and special requirements such as medical needs, diet, requirements relating to disabilities, and any other requirements before confirming your booking so that we are sure we can meet the required preferences.
6. In case of any need to amend your booking, Africa Tours Adventure shall make the preferred amendment, and in case there is any need to adjust the cost, it will be communicated and updated on the invoice.
7. Africa Tours Adventure Ltd reserves the right to adjust the tour itinerary, accommodation, transportation and services indicated in the schedule in the event of unforeseen circumstances before arrival and any changes will be communicated to the client as soon as possible.

 

2. TOUR EXECUTION.

2.1. Animals live in their natural wild and it is always a privilege to see them. Therefore, Africa Tours Adventure Ltd does not guarantee to see the animals while on a game drive or tracking. You must be cautious when seeing the animals and adhere to the instructions given by the tour guide or wildlife rangers.

2.2 Gorilla and chimpanzee tracking permit guarantees that you will be able to track the primates, but does not guarantee that the animals will be easily seen.

2.3 Africa Tours Adventure reserves the right to upgrade you to a superior lodge or switch you to similar lodge of the same standard in case there is no availability of the initially provided accommodation. This will be done at no extra charges and in case there is any need, the change will be communicated.

2.4 The vehicle used for transportation will be dependent on the number of guests and the travel itinerary. In case there is no need for game drive for example, a non pop up roof vehicle may be used. Africa Tours Adventure ensures that vehicles provided are in good conditions. However, no liability can be accepted for a puncture, breakdown, damage, or any delay as a result of the poor road conditions.

2.5 Africa Tours Adventure Ltd employs experienced English-speaking drivers/guides(or any other special Language guide) who are key to your tour. Only guides deployed from Africa Tours Adventure are permitted to drive the vehicle provided. The driver/guide’s decision while on safari is final since it is meant to make the safari a success.

2.6 Africa Tours Adventure reserves the right to change the route or cancel the operation of any scheduled tour in case of unforeseen circumstances, such as road closures, bad weather, problems with national parks, security considerations. In such an event, there will be alternative arrangements.

2.7 Africa Tours Adventure reserves the right to use subcontractors to carry out part or all the agreed services.

2.8 Africa Tours Adventure Ltd reserves the right to refuse any person from participating or continuing any tour if, in our opinion or in the opinion of any other person in authority, Our Terms & Conditions the person concerned behaves in such a way that causes or likely to cause danger, hazard or inconvenience to any third party, damage to property or to environments and ecosystems. No refunds will be made and Africa Tours Adventure shall not be liable for expenses incurred as a result of the termination.

 

2. PRICES
3. The price quoted in the itinerary shall include all the activities covered in the itinerary, accommodations, transportation, guiding fees among others. The price inclusions and exclusions shall be communicated at the time of booking.
4. Expenses that are not included in the itinerary shall be highlighted and in case of any need to be included, Africa Tours Adventure shall ably communicate the possibility.
5. Prices listed on the website or quoted are subject to change without notice and are not guaranteed until confirmed in writing.
6. Africa Tours Adventure reserves the right to adjust prices at any time in case there is fluctuation in the exchange rate or an increase in the cost of any element of the tour. We shall try as much as possible to minimize price changes and this will be communicated in due time.

 

4. PAYMENT

4.1. Upon confirmation of the safari with Africa Tours Adventure Ltd, we shall require you to pay 40% of the total tour cost.

4.2. In case the safari involves gorilla tracking, you will be required to pay the full amount of the gorilla permit in case the booking is done 6 days to the tracking date.

4.3. The balance for the safari/tour shall be paid at least two weeks prior to safari commencement. Africa Tours Adventure reserves the right to cancel any booking in case the payment terms are not met.

4.4. The payment is made by international money transfer to the company bank account in Uganda which is paid in USD. You can also choose to pay online using a credit card using pesapal or DPO service. Note that Credit card payments carry 4% bank charges. The bank wire transfer charges and Credit card charges shall be fully paid by the clients.

5. OUR CANCELLATIONS

5.1 All cancellation requests must be made in writing and shall be effective on the date of actual receipt by Africa Tours Adventure Ltd.

5.2 The following cancellation charges apply:

90 days or more prior to arrival       Full Refund.

60-90 days.                            10% charge.

59 – 32 days prior to arrival          20% charge

31 – 8 days prior to arrival           50% charge

7 – 3 days prior to arrival            75% charge

48 hours or less prior to arrival      100% charge

Africa Tours Adventure reserves the right to deduct all expenses incurred from money paid.

There is no refund of any unused portion of your safari once inaugurated.

Importantly to note is; Gorilla Permit and Air tickets are not refundable when already booked.

 

6. COMPLAINTS

Africa Tours Adventure tries to ensure that we exceed the expectations in every area of the tour arrangements. However, we are always open to more improvements and therefore welcome suggestions.

Complaints shall be reported immediately to the Africa Tours Adventure representative and the supplier of the service in question, who will do their best to resolve the matter. If the problem is not resolved to the client’s satisfaction, the complaint shall be reported in writing and not later than 30 days after completion of the tour.

Liability for any complaints not notified in accordance with the above-described procedure cannot be accepted.

 

1. LIABILITY
2. Africa Tours Adventure makes every effort to ensure that all arrangements and services offered as part of the safari are executed in the most efficient way possible. However, we do not have direct control of the provision of services by suppliers. Though the suppliers are chosen with care and scrutiny, Africa Tours Adventure does not accept liability for errors or omissions of such suppliers.
3. Africa Tours Adventure shall not be liable for any loss, damage, or injury of any nature whatsoever whether to person or property.

iii. Though there is always enough care provided, Africa Tours Adventure cannot be held responsible for the direct or indirect costs of loss or damage to baggage or personal possessions.

1. Africa Tours Adventure Ltd shall not accept liability or pay compensation for unforeseen circumstances beyond the control of the company or its staff, including flight delays/cancellations or force majeure such as war or threat of war, ivil disturbances, terrorist acts, riots, border closure, acts of government or other authorities, industrial disputes, natural or nuclear disaster, strikes, thefts, epidemics, road closures, extreme weather conditions, fire, technical or mechanical problems to transport and all similar events beyond the company’s control.

 

1. It is the responsibility of the Client or travel agency/wholesaler to ensure that all the participants of the safari have the appropriate passports, visas, travel permits, health certificates, Our Terms & Conditions, and other documentation required for the safari.
2. It is the responsibility of the guests to take proper medical and practical precautions in regard to health and safety. Medical advice should be sought well before traveling.

vii. Guests are strongly advised to obtain travel insurance before coming for the safari.

viii. The respective laws of the country govern Africa Tours Adventure’s liability to passengers carried in its own vehicles. All claims are subject to the jurisdiction of the courts of the country in which the cause of action arises.
